What is a letter of advice?

A letter of advice confirms, in writing, the advice a lawyer gave a client. It sets out the facts relied on, the answer to each question, the options and risks, and what happens next.

It gives the client something to keep and act on. It also shows, later, exactly what was advised and on what facts.

  • Documents

What to include

  • The facts you relied on

As the client gave them, with an invitation to correct anything wrong.

  • The questions

What the client asked you to advise on, in their terms.

  • Your advice

A direct answer to each question, with the reasons.

  • Options and a recommendation

The realistic paths, their risks, cost and time, and which you recommend.

  • Time limits and risks

Any deadline, stated plainly, and what happens if it is missed.

  • Next steps

What the firm will do, and what the client needs to do by when.

  • Workflow

How to write a letter of advice

  1. 01

    Answer the question first

Lead each section with the answer, then the reasons.

  2. 02

    Write for the client

Plain English, short sentences. Explain any legal term you have to use.

  3. 03

State the facts you relied on

And ask the client to correct them. Your advice depends on them.

  4. 04

    Make deadlines impossible to miss

Give the date, and what happens if it passes.

  5. 05

    End with actions

Who does what, by when. The client should know their next step.

  6. 06

    Send it promptly

The same day, while the client remembers the conversation.
